Clauses

|
1°- |
|
We engage ourselves, as THE BREEDER, to send
to THE BUYER the registration certificate form the Canadian Kennel Club with a NON-BREEDING
agreement as soon as we will receive it. Also
a minimum of a three-generation pedigree upon release of the puppy. |
|
|
|
|
|
2°- |
|
The dog will carry the prefix BOYERO and
following by the letter of the litter. No
other kennel’s name must be included. |
|
|
|
|
|
3°- |
|
THE
BUYER will have to spay or neutered the dog before the age of year old, unless a
special agreement with THE BREEDER or the earliest age as discussed with the
buyer’s veterinarian. |
|
|
|
|
|
4°- |
|
The dog is sold on a NON-BEEDING agreement
and it will remain so throughout it’s life and may not be bred at any time under any
condition, unless a special agreement with THE BREEDER. |
|
|
|
|
|
5°- |
|
The dog was sold in good health, free from
communicable diseases (as well as can be visually determined) and has been immunized up to
the date sold, the rest of the shots being at THE BUYER charge. The health of this animal is guaranteed for three
working days through examination by a veterinarian at the discretion and expenses of THE
BUYER. However, THE BREEDER will
not be held liable for any damage or injury caused negligence or accident. If the dog is found to be of unsatisfactory health
and written documentation of the condition is presented: |

|
According to the assent of the two parts at the time
of the sale. |
|
|
|
|
|
6°- |
|
The dog is guaranteed to be free of hip dysphasia
and any other hereditary disabling defects visible (i.e. lameness) by thirty (30) months
of age.
Determination of what constitutes a hereditary defect is to be a unanimous
agreement of two veterinarians agreeable to both parties.
(One veterinarian is to be a tenured faculty member of an accredited university
veterinary teaching hospital of board certified in the applicable field - OFA, CERF).
Costs of the opinions are to be assumed by THE BUYER.
If such a problem should develop, THE BUYER has two choices; |

|
| a) |
THE BREEDER take bake the dog (with registration certificate) and
replace the dog with the next available like prospect of mutually agreeable dog (for only
the cost of ear cropping & shots) or 100% refund if no litter is expected in a
reasonable delay (12 months). |
|
|
| b) |
If THE BUYER wand’s
to keep the dog and this one can have a good life quality, THE BREEDER will refund
50% initial price to THE BUYER.
However, the dog will have to be castrated obligatorily if not already made. The
price of castration is including in the refundable like those of the corrective chirugies
and/or the veterinary care, drugs connected specifically to this problem. Refunding will
be given to the reception of written attestation of the veterinary surgeon of the
dog’s castration. No other amount can be claim by THE BUYER to THE BREEDER. |

|
|
The decision is between the
breeder and the buyer and fulfilled within one year of the problem developing.
This guarantee does not apply to any damage, neglect or injury caused negligence of
accident.
It isn’t in consideration a hereditary defect present at the moment of the sale and
sight by the two parts. |
|
|
|
|
|
7°- |
|
THE BUYER commits himself not to have his dog put to sleep
without THE BREEDER’S prior agreement, with less urgency, serious wounds and
with veterinary opinion. |
|
|
|
|
|
8°- |
|
The dog is sold as a companion
and can not participate to any CKC or AKC Conformation dog show, unless a special
agreement with THE BREEDER. |
|
|
|
|
|
9°- |
|
THE BUYER agree to offer a good home to the dog, this dog is sold as a
companion. THE BUYER will provide
regular exercise to the dog, in any situation the dog will be left alone outside. THE BUYER agrees to confine the dog in a
fenced yard, kennel run or walk on a leash but NOT restrain the dog on a rope,
chain or tether. |

10°- |
|
THE BUYER agree to keep the dog clean and properly
groomed, provide the dog with human living conditions and adequate housing. |
|
|
|
|
|
11°- |
|
THE BUYER agree to follow recommended feeding guideline. The annual veterinary checks, including yearly
heartworm test, to properly administer a heartworm preventative, and any other health care
needs. THE BUYER will have to make
promptly look after the dog aforementioned and/or dog diseases. |
|
|
|
|
|
12°- |
|
THE BREEDER guarantee all puppies have sound and stable temperament,
it has the breed his. BUT, THE BUYER
must socialize the dog in is first year (a specially the first 6 months). To attend and participate with the dog in at least
a basic obedience course by at least six months of age no later than eight months with a
recognize trainer or club. THE BUYER
commits himself not to have his dog trained as an attack dog. Same warrant and exception has hereditary disease. |

|
13°- |
|
For
any reason, if THE BUYER be obliged to get rid of the dog, the dog will have to be
returned to THE BREEDER without refund of purchase costs.
Any dogs returned to THE BREEDER for re-homing will become the property of THE
BREEDER. THE
BUYER doesn’t have the right to sell the dog, neither gives the dog to anybody or
to get rip of the dog in anyway.
On
the other hand, if THE
BUYER wishes
to give to the dog to a close relations, it can do it only with
THE BREEDER’S agreement.
THE
BREEDER considers themselves responsible of the welfare of the dogs at every moment of
this life.
Therefore, it is our responsibility to find a new family for the dog and this
according to our own welfare criteria. |

|
14°- |
|
If the owner (BUYER on this contract) dies,
the succession must respect the contract AND in entirety just like the late one
will do it. In the same way, if THE BREEDER dies, his succession must respect the
contract. |
|
|
|
|
|
15°- |
|
THE
BREEDER, notwithstanding the present sale, keep the right to see the dog in any time
with a phone call 48 hours before. In caste
of abstraction by THE BUYER, THE BREEDER wills advice the authority. |
|
|
|
|
|
16°- |
|
THE
BREEDER has the right to take back the dog if for any reason he thinks that dog is
neglected, physical and mental heather by the boyer, is family or any other people in
contract (with the expertice of a knowlegeble person in that matter: serious breeder,
veterinary, SPCA…) without paying anything to THE BUYER (on this contract). |
|

|
|
17°- |
|
If THE BUYER doesn’t respect these
conditions, in part or in all, he engage himself to give back the dog and to indemnify THE
BREEDER for a amounts which can go up to twenty five thousand dollars ($ 25 000.00) for not respecting the contract. |
|
|
|
|
|
18°- |
|
If for any reason THE BREEDER take bake the
dog mention on this contract, THE BUYER (on this contract) will give back the
registration certificate and sign the property transfer and all the other paper needed. A penalty of
$ 25.00/day will be charge to the owner (THE BUYER on this contract) if
there is any delay in signing the paper needed by THE BREEDER, after he take back
the dog.. |

|
19°- |
|
In the event of litigation
relating to this contract's application, THE BUYER and THE BREEDER will be
choose together a specialist as referee. |
|
|
|
|
|

|

By signing that contract, THE
BUYER take the responsibilities of respecting it, whether he has read it entirely or
in part. He will respect the non-breeding
contract for the weld fare of the breed and his animal. |

25°- |
|
THE BUYER must notify THE BREEDER of any change of address and
phone number. THE BUYER will from time
to time advice THE BREEDER of the dog’s progress and will not hesitate to
contact us for advice on any problems or questions that THE BUYER may encounter. |
|
|
|
|
|

health, registered. It’s the
buyer’s responsibility to love,
coddle and educate the puppy. We have done
all the necessary efforts to sell you a health puppy,
sweet,
friendly and affectionate. It’s up to
you to continue these efforts and to assume
the responsibility of your purchase. Thank
